At PeakifyX, we eliminate financial risk for businesses. We never require 100% advance payment for custom agency projects. Every service is backed by transparent milestone billing, written deliverables scope, and official GST tax invoices.
1. The Parties & Legal Entity
These Terms of Service constitute a legally enforceable agreement between you ("Client") and PeakifyX ("Agency"), a legally recognized proprietorship enterprise registered under the Goods and Services Tax Act, Government of India (GSTIN: 09DUDPM7256Q1ZP), having its principal place of business at 26/1 Zer Khirki, Chipyana Chauraha, Unnao, Uttar Pradesh - 209801, India.
2. Milestone-Based Payment Structure
To ensure 100% client peace of mind and accountability:
- Standard Project Model: Projects begin with a standard milestone initiation deposit (typically 30% to 50% depending on the chosen package).
- Delivery Approval Milestone: The remaining balance is payable ONLY after the project milestone (website staging preview, ad campaign setup, or video edit draft) is reviewed and approved by the Client.
- GST Invoices: Official B2B GST Invoices are generated for every payment, allowing registered Indian business entities to claim 100% Input Tax Credit (ITC).
3. Written Scope of Work (SLA)
Before any project begins, PeakifyX provides a defined Scope of Work detailing:
- Specific deliverables (number of website pages, features, ad creatives, or reels).
- Target completion deadlines and review milestones.
- Technical stack, hosting environments, and access credentials.
4. Client Asset Ownership & Code Handover
Upon final milestone clearance, the Client retains 100% full ownership of all deliverables:
- Complete website source code, database dumps, and server access.
- Raw and rendered video project files and graphic design master files.
- Meta Ads and Google Ads account ownership remains directly in the Client's Business Manager.
5. Revisions & Quality Guarantee
Every development and creative package includes dedicated revision cycles. We work iteratively until the deliverables match the agreed design specifications and functionality criteria agreed upon in the project scope.
6. Governing Law & Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these services shall be subject to the exclusive jurisdiction of the competent courts in Uttar Pradesh, India.
